MINNEAPOLIS – A federal judge has ordered the immediate release of a five-year-old boy and his father, who were taken into custody earlier this week in Minneapolis, sparking a wave of local and national outcry over the administration’s intensified immigration enforcement tactics.
The ruling, delivered late Friday, comes after civil rights attorneys filed an emergency petition arguing that the detention of the child was a violation of existing legal protections regarding the treatment of minors. The father and son, whose identities have been partially withheld for their protection, were reportedly detained during a targeted operation in a residential neighborhood, an action that witnesses described as “swift and aggressive.”

A Legal and Humanitarian Flashpoint
The case has become a lightning rod for criticism of the Trump administration’s “zero-tolerance” approach to border security and internal enforcement. In his decision, the judge cited the “irreparable harm” caused by the detention of a minor in a facility ill-equipped for childcare, noting that the government had failed to provide a sufficient legal basis for the separation of the family unit in this specific instance.

“The safety and psychological well-being of a five-year-old child must outweigh administrative processing concerns,” the court stated in its summary.
Advocates gathered outside the federal courthouse in Minneapolis celebrated the news, though many warned that this case is only a symptom of a much larger shift in policy. “This is a victory for one family, but there are thousands more facing the same uncertainty,” said a representative for a local immigrant rights coalition.
Political Fallout
The incident has also resonated in Washington, where lawmakers are increasingly divided over the use of federal resources for large-scale raids in “sanctuary cities.” While the administration maintains that such operations are necessary to uphold the rule of law and national security, local officials in Minneapolis have condemned the tactics as “traumatizing” to the community.
Governor Tim Walz and Minneapolis Mayor Jacob Frey had both previously called for the release of the pair, emphasizing that the city’s resources should be focused on public safety rather than assisting in federal immigration sweeps.
As of Saturday morning, the father and son have been reunited with their family under supervised release while their underlying case continues to move through the court system. The Department of Justice has not yet indicated whether it intends to appeal the judge’s order.
